The exam, which tests skills in the area instructors teach, is required to renew a teaching certifi- Former Legislator Moss Dies At 68 YORK (AP) Services for James Lewis Moss, a longtime member of the South Carolina Public Service Commission and a former state legislator, were scheduled for Tuesday in Rock Hill. Moss died Sunday at age 68.

Moss served on the PSC board for 29 years, making him one of the longest-serving utilities regulatory commissioners in the history of the United States when he retired in 1982. He also served several terms as chairman of the commission. Moss, who was born in Chester County, represented York County in the state House of Representatives from 1950 until 1953, when he joined the PSC. He also was a sheriff's deputy for York County, a Rock Hill policeman and a South Carolina Highway Patrol officer. He was a permanent member and past president of the executive committee of the National Association of Regulatory Utility Commissioners and served as chairman of the NARUC committee.

Surviving are his sons, Charles A. Moss III of Columbia and J. Lewis Moss Jr. of Mount Pleasant; daughters, Eva M. Smith of Rock Hill and Patricia M.

Puerto Rican Singer, Guitarist Aviles Dies MEXICO CITY (AP) Puerto Rican singer and guitarist Hernando Aviles, a founder and lead singer of the famous trio Los Panchos, died in Mexico City after a long illness. He was 72. Aviles had been hospitalized since May 10.

He was initially treated for heart trouble and later for other problems, including a kidney infection. He had been in coma for 10 days when he died Saturday, the government newspaper El Nacional said. He was buried Sunday. El Nacional said Aviles had suffered a heart attack last Sept. 19, apparently induced by the devastating earthquakes in Mexico City that day.

Chucho Navarro, who in 1944 with Aviles and Alfredo Gil created the Los Panchos trio that was to travel much of the world, improvised a verse as he paid his last respects to Aviles Saturday night. "Your song gave us happiness and emotions, was the will of God, in the circus of life there is no good-bye, simply so long," Navarro said. He said Aviles left the trio because he was tired of traveling. Born in Puerto Rico in February 1914, Aviles had a talent as a singer and composer, which was apparent at an early age in his life. In Puerto Rico he formed the duet Azteca before joining Los Panchos.

Later he created Aviles Quartet and Los Tres Reyes, or The Three Kings. He also sang as a soloist in his own clubs. Los Panchos' hits included "Perdida" (Lost), "Rayito de Luna" and "La Magdalena." Others were "Me Pa'l Pueblo" (I'm Going to the Village), "Sin un Amor" (Without a Love), "Depende de Ti" (It Depends on You), "Sin Ti" (Without You) and "Contigo" (With You). Illness prevented him from attending a ceremony in honor of Los Panchos in the Puerto Rican congress last February. He is survived by his widow.

The Georgia Association of Educators, reacting to the results, renewed its complaint that the test is racially biased and should not be used as the only criterion for keeping a teacher on the payroll or issuing a certificate.

New teachers have had to pass the test since 1978 to get a job. Under QBE, teachers with lifetime certificates issued before 1974 are not required to take the test. But teachers with certificates that expire are required to pass test once in their career in order to renew their certification. The state has granted a one extension for teachers whose certificates expire this year to pass the test. The Department of Education said 90 percent of the 14,944 educators who took the test in the four times it has been administered since September passed.

Georgia is the only state that tests teachers in their field of certification as a requirement for maintaining a teaching certificate. To protest the exam, GAE and a black education graduate who failed the test filed a complaint with the Equal Employment Opportunity Commission July 11, charging the exam discriminates against blacks and is not jobrelated. The Department of Education results show that 81 percent of the 11,867 teachers who took the test in May passed it. Eighty-one percent passed the test in March, compared with 76 percent in December, and 68 percent in September. Ofthe teachers taking the test for the first time, 61 percent of the blacks passed compared to 94 percent of whites.

When those who failed tried again, 75 percent of the whites passed compared with 66 percent of those who are black. The money was used to pay bank loans, Simpson said. The third offense started as a legitimate bank transaction. but when neither of the partners of a company requesting a loan of $8.000 were there to collect the loan Simpson was to deliver, he kept it. Simpson said he later gave the money to his legal attorney, who told a company official that he had the funds, but the company official had been questioned by investigators about the funds and was reluctant to take it. Simpson faces a maximum sentence of five years in prison, a $250.000 fine and could be ordered to pay restitution, Hamilton said.

Simpson's attorney, Charles Porter, said Simpson had already paid $87.038 in restitution, which includes interest..
